OF SUPPLY
The supply of goods by
FrownFaders.com
('the seller') shall be subject to and conditional upon acceptance of the
following terms and conditions which shall apply notwithstanding any
purported waiver, expressed or implied, by or on behalf of the seller. Where
there is any conflict between these conditions and any proposed by the buyer
(including reseller) of the goods ('the buyer'), these terms and conditions
shall apply. Any condition the buyer wishes to apply on any supply of goods
must be specifically agreed in writing by the seller.
PRICES
All prices quoted by the seller are subject
to alteration without notice unless otherwise expressly agreed in writing by
both parties.
VALUE ADDED TAX
There is no VAT payable or reclaimable
until further notice
OUR LIABILITY
Save in
respect of your statutory rights under the Sale of Goods Act 1977 (as
amended) and the Unfair Contracts terms Act 1977 and in respect our refund
guarantee, we shall not be liable to you by reason of any implied warranty,
condition or other term, or any duty at common law, or under these terms of
our contract with you, for any indirect, special or consequential loss or
damage (whether for loss of profit or otherwise), costs, expenses or other
claims for compensation whatsoever (whether caused by our negligence) which
arise out of or in connection with the supply of the goods or their use by
you including without limitation, warranties of
merchantability and fitness for a particular purpose. In
addition, does not represent or warrant that the information contained or
accessible via this website is accurate, complete or current.
OUR GUARANTEE TO USERS
"Purchases
made on-line direct from Frownfaders.com. You
are guaranteed satisfaction or full refund of your purchase price after 70
days subject to having used
FrownfadersTM
line and wrinkle care for at least 60 days in accordance with the
instructions provided, and to the submission of the completed claim
form available by email from:
guarantee@frownfaders.com.
You will need to return the claim form by
email, and then send your completed 60-day Progress Report together with the
unused portion of your Frownfader pack to the address provided on the claim
form between 70 and 90 after purchase.
Claims for refunds will not be accepted
outside of this time period.
Refunds will be made to the credit card or Paypal account you
used when making the purchase.
Purchases made from appointed Resellers:
The above conditions apply except that it
is the responsibility to the Reseller to issue the refund and to return the
unused product to Frownfaders.com
in accordance with their agreement with us. This guarantee does
not affect your statutory rights".
RESELLERS
FrownFaders.com
will supply approved resellers subject to the following conditions:
1)
Resellers are
supplied on a confirmed pre-paid sale basis and, save in respect your your
statutory rights, and unless otherwise stated, no refunds will be made.
2)
The reseller agrees to refund in full his/her customers in accordance with
the FrownFaders.com “Success or Money-Back Guarantee” and FrownFaders.com
agree to replace to the reseller any such returned product with a new and
unused item upon receipt of the partly used product that the customer
returned to the reseller. This clause does not apply to affiliates
who do not physically handle the product.
3)
The reseller agrees
not to advertise any FrownFaders.com product (other than by word of mouth)
without first submitting the proposed advertising copy to FrownFaders.com
for written approval prior to publication. Specifically, no advertising
online, radio or in printed advertisements or leaflets. Furthermore,
the reseller agrees not to make any claims or representations for the
product other than those made in FrownFaders.com official literature,
advertisements or websites.
4)
Nothing in this Agreement or otherwise shall make the Reseller an employee
of Frownfaders.com or its principals and the Reseller
affirms that the declaration of all taxable income to relevant authorities
is entirely the his/her responsiblity.
Any breach of our terms will result in withdrawal of the reseller’s
right to supply.
GENERAL
In general any
dealings which the seller may enter into, including any contracts for the
supply of goods which may subsequently be entered into, with other parties
including buyers and resellers shall be contracted by the conditions above
mentioned. In addition the seller will ensure that no condition which the
buyer may seek to impose on any subsequent contract between buyer and seller
conflicts with any of the previous conditions under which the seller
operates. Should such conflicts be discovered subsequent to the commencement
of a contract then the seller reserves the right to terminate without
further notice any such agreement, in which case the seller will have no
liability in respect of any losses or damage or expenses arising therefrom.

Derma-PadTM,
Derma-PadsTM
are the intellectual property of the proprietor
FrownFaders.com
and are enforced and protected under
“Intellectual Property” copyright by UK and international laws. Except in
connection with placing an order for merchandise or as required by
applicable law, you may not use, reproduce, duplicate, copy, sell, resell,
access, modify or otherwise exploit our intellectual property without our
prior written consent.
Any breach of our terms will result if withdrawal the reseller’s right to
supply.
